CLOUD19.COM PRIVACY POLICY
Last Revised January 1, 2006
General Policy. Cloud19.com, ("Cloud Nineteen", "we", "us") shares your concern about the protection of your personal information online. This is our policy regarding the privacy of information we collect on our website Cloud19.com, and any subdomain thereof (the "Site").
Children. Our Website is currently available only to persons thirteen years of age or older. We do not collect user information from any visitors indicating they are under thirteen years of age.
The Information that We Collect. As further described below, we collect two types of data about visitors to the Site ("Site Visitors"): (a) personal information that individual Site Visitors provide when registering to use one or more of our services ("Registrants"), or voluntarily at certain other points; and (b) tracking data, which is automatically collected from every Site Visitor.
- Personal Information. We collect personal information about you when you volunteer such information, such as your first name and e-mail address. For example, this information will be collected when you complete a registration form to use one or more of our services ("Registration Information"), or when you complete other forms on the Site, such as to enter a contest. We may also collect information about your transactions with us or our affiliates, and your Site usage patterns, such as the pages on the Site you have visited and the amount of time you have spent on the Site. If you contact us, we may keep a record of your correspondence. Wherever we collect personal information from you online, we will make an effort to include a link to this Privacy Policy on that page. We may retain personal information you provide us for internal use, such as to provide you with an enhanced or customized experience.
- E-mail Updates. Unless they opt out as provided below, Registrants will automatically receive various e-mail updates and bulletins that we send out on a periodic basis containing selected items about artists and their music. Such updates and bulletins may include third-party advertisements and hyperlinks to the Site.
- Surveys. We may ask Site Visitors to participate in surveys from time to time, which are typically aimed at obtaining general information about Site Visitors. Because information obtained in these surveys is connected with individual Site Visitors and is used internally to better market our services, participation is voluntary.
- Sweepstakes and Contests. We may from time to time offer sweepstakes or contests, which require additional personal information to participate, for example, so we can verify each entrant’s eligibility and identity, and so we can notify winners. Participation in such sweepstakes and contests is voluntary.
- Purchases. If you purchase products or services on the Site, we may collect additional information from you, such as your address, phone number, payment information, or shipping information. We will not release payment information to third parties except as necessary to complete a transaction between you and such third party, or to otherwise fulfill your order. Credit card transactions are handled by a third-party service provider, which receives the credit card number and other personal information only to verify the credit card number and process transactions.
- Tracking Data. Tracking data consists of non-personal information we collect automatically from each Site Visitor that is not associated with an identifiable non-personal individual, such as their browser type, operating system, Internet service provider, or referring site. Tracking data includes aggregate information, such as the total number of Site or page visits, and the average time Site Visitors spend on the Site.
Cookies. Cloud Nineteen may place Internet cookies on your hard drive. Internet cookies are small files that may be placed on your hard disk for record-keeping purposes. Cookies are used to (a) remind us of who you are in order to deliver you better service; (b) estimate our audience size by determining repeat usage of the Web site to help target advertisements based on user interests and behavior; (c) track your progress and entries in any promotions, sweepstakes, and contests; and (d) measure certain traffic patterns for use as a research tool to understand how our users' habits are similar or different from one another. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. By not accepting cookies, some Web pages may not display properly or you may not be permitted to access certain information.
Cloud Nineteen also collects IP addresses (the Internet address of a computer) to track a user's session while the user remains anonymous. We analyze this data for certain trends in statistics, such as which parts of our site users are visiting and how long they spend there. In general, we do not link your IP addresses to anything personally identifiable to you. In those limited cases where session information is not anonymous, Cloud Nineteen will provide notice of the practice and an opportunity to "opt out".
Advertising networks that serve ads onto Cloud Nineteen may also use their own cookies. The content of such cookies and the use of the information they contain is controlled by the third party advertising network placing them, not by Cloud Nineteen. If you would like a list of the advertising networks with whom Cloud Nineteen does business, send an email to webmaster@cloud19.com.
How We Use the Information. We use and disclose information obtained from Site Visitors as stated in this Privacy Policy and as permitted by law. We do not rent or sell personal information about our Registrants or other Site Visitors. We will not disclose personal information to third parties, except when we believe in good faith that the law requires it, to enforce our Terms of Service [add link to Terms of Service agreement], to protect the rights, property, safety or security of Cloud Nineteen, Site Visitors or the public, to respond to an emergency, or as otherwise stated in this Privacy Policy. We may also disclose information if you have given us permission to do so, for example by voluntarily entering a contest or making a purchase on the Site, where we provide the information required to register for the contest or to ship your purchases to the appropriate third-party service provider. We use tracking data to create anonymous, aggregate reports on Site Visitor demographics, Site traffic patterns, and consumer behavior. None of the information in the reports can be connected to the identities or other personal information of individual Site Visitors. Although we do not currently do so, we may in the future link tracking data we collect with personal information we collect from our registration forms. Once we make such a link, all of the linked information is treated as personal information. We may use such information to provide you with an enhanced or customized experience.

We work with third parties who provide services which may include website hosting, order processing and fulfillment, credit card clearance, e-commerce affiliation, data analysis, e-mailing and other services of an administrative nature. Personal information, including financial information, may be shared with such third parties for the purpose of providing such services. We seek to impose confidentiality obligations on such service providers.
Site Notices. From time to time, in our sole discretion, we may e-mail Registrants important information regarding their use of the Site or changes to this Policy or our Terms of Service. Registrants may not opt out of receiving such information.

Exclusions. This Privacy Policy does not restrict or prohibit our use or disclosure of public information. We reserve the right to transfer any and all information that we collect from Site Visitors to a third party in the event that we sell or transfer substantially all of our assets related to the Site to such third party.
